From the Working Group for the Inception of a Boston United Supporters’ Trust

Serious concerns have been raised over the past few weeks by members of the Working Group for the Inception of Boston United Supporters' Trust over information that has come to light regarding the planning application submitted by the present Boston United chairman, Jon Sotnick, and the involvement of Sportsfunds (Boston) Limited, the owners of Boston Town FC's ground.

These concerns raise important questions of governance, propriety, and conflict of interest regarding the relocation of both football clubs as proposed by Lavaflow Ltd.

Supporters of Boston United, Boston Town and the people of Boston should be made aware that at one particularly significant time there was a current Boston United board member who was the Chairman and spokesperson of Sportsfund (Boston ) Ltd.

Furthermore, the owners of Boston United's York Street ground were also on the board of Sportsfund Limited. With these appointments to the Board of Sportsfund, there was, on the face of it, a significant shift in the balance of power to a number of people who potentially stood to make a financial gain from the sale of land at York Street and Tattershall Road and its subsequent redevelopment.

As recently as 5 years ago, Sportsfunds was looking to handover the freehold of Tattershall Road to Boston Town FC. This was still an option in early 2001.

In June 2001, Boston Town Football Club received confirmation that the offer of transferring the ownership of the Tattershall Road football stadium was being withdrawn, and that all future correspondence with Sportsfunds should be made to Mr Ralph Jenkin. It is unclear at the present moment who actually owns the freehold of the Tattershall Road stadium, and surprisingly, even some members of the Boston United Board do not appear to have the answer to this question.

Further important questions remain to be answered as to how the wholesale changes were made to appointments to the Sportsfund Board. In addition, an announcement urgently needs to be made as to how the resolutions which Sportsfund made at the time comply with its Memorandum of Association section 4:

The income and property of the Company whencesoever derived shall be applied solely towards the promotion of the objects of the Company as set forth in the Memorandum of Association, and no portion thereof shall be paid or transferred, directly or indirectly, by way of Dividend, Bonus or otherwise howsoever, by way of profit to the Member of the Company

The Working Group will be raising further questions related to the Lavaflow Consortium at the Fans' Forum to be held at 7:00 p.m. this Wednesday (14th September) in The Assembly Rooms, Market Place, Boston.
